Official Rules for the Wotif.com ‘Make Up For Missed Holidays’ Competition


The “Make Up For Missed Holidays” Competition (the “Competition”) is in no way sponsored, endorsed or administered by, or associated with Instagram (“Instagram”) or Facebook (“Facebook”) (the “Competition Platforms”). You understand that you are providing your information to the Sponsor (defined below) and not to Instagram or Facebook. The information you provide will only be used for the administration of this Competition and in accordance with the Sponsor’s privacy policy (see below). Instagram and Facebook are hereby completely released of all liability by each entrant in this Competition. Any questions, comments or complaints regarding the Competition must be directed to the Sponsor and not to Instagram or Facebook. You may only use one (1) Instagram or Facebook account (“Platform Account”) to participate in this Competition.

In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Competition.

1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

2. Promoter: The promoter of this Competition is Expedia Australia Pty Limited ACN 101 694 946 of Level 18, 1 Martin Place, Sydney (”Expedia”) and the Sponsor of this Competition is Expedia, Inc., 1111 Expedia Group Way W., Seattle, Washington 98119 USA.

3. Eligibility: The Competition is open only to legal residents of Australia who are at least eighteen (18) years old at the date of entry and have a Platform Account and who otherwise meet the requirements set out in these Official Rules. If you do not have an Instagram Account, visit http://instagram.com and register in accordance with the enrolment instructions for a free Account. If you do not have a Facebook Account, visit http://facebook.com/ and register in accordance with the enrolment instructions for a free Account. Employees of the Promoter or Sponsor, their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.

4. Competition Period: The Competition Period begins at 9:00 am AEDT 19 July 2022 and ends at 5:00 pm AEDT 29 July 2022. Entries submitted before or after the Competition Period will not be eligible. Promoter’s computer is the official time-keeping device for the Competition.

5. How to Enter: This Competition is a game of skill and chance plays no part in the winner selection process. To enter the Competition, you must, at any time during the Competition Period, complete the following:

i. Visit https://facebook.com/wotif or https://www.instagram.com/wotifcom/ and locate the competition posts.

ii. If entering on Facebook, comment on the designated competition posts with your holiday photo. If entering on Instagram, upload your holiday photo to your profile, tag and follow Wotif.

iii. If entering on Instagram, ensure your profile is set to public for your entry to be valid.

IMPORTANT NOTE: Standard text messaging, data and/or other rates apply to participants who submit a Post via a wireless mobile device. Wireless service providers may charge for airtime and/or data in relation to each standard text message sent and received. Please contact your service provider for pricing and service plan information and rates before mobile device participation.

Limit: Each entrant may post up to two (2) Entries (one (1) Entry per Competition Platform) during the Competition Period. Entries received from any person or Account in excess of the stated limit will be void. Entries generated by script, macro or other automated means are void. Uploading an Entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display, such entries in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry. Released Parties (as defined below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Entries; all of which will be void. The entrant further agrees, represents, warrants and guarantees to Promoter that:

a) they have and will maintain all necessary rights, consents, approvals, authorizations, licenses and rights in and to all Entries and all information they contain in order for Promoter and its sublicensees to use the Entries and exercise the rights granted herein;
b) the uploaded Entry does not include photos or information about children or any third parties without their consent (or a parent or legal guardian’s consent in the case of a child under 16 years of age; and
c) If the Entry contains any personal data of individuals, the entrant agrees, warrants and represents that they have obtained consent of these individuals for (a) their likeness and/or personal data to be included in the Entry; and (b) the collection, disclosure, transfer, processing and use of their personal data by the Promoter in accordance with these Terms and Conditions and the Promoter’s Privacy Policy, accessible at https://www.expedia.com.au/lp/lg-privacy.

 

6. Competition Judging: On Tuesday, August 2 2022 at 12:00pm AEDT at Level 18, 1 Martin Place, Sydney, Australia, all valid entries will be judged by the Promoter on the creativity and originality of the entrant’s answer. There will be five (5) winners for each Competition Platform (ten (10) winners in total) judged in respect of this Competition from all eligible entries received during the Competition Period. The winners will be the valid entries submitted in accordance with these Official Rules that is judged a winner by the discretion of the Promoter based on creativity and originality of the Entry Content. The Promoter will notify the winners within two (2) business days of the prize judging, via their post provided in their chosen Competition Platform.

7. Sponsor’s Rights to Submissions: By entering, you grant Promoter, Sponsor, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party. You agree that the Promoter may use the aggregate information collected from the competition for related research and marketing purposes. Participants warrant that their entry is their own work.

8. Potential Winner Requirements: The potential winners may be required to submit to the Promoter and Sponsor their first name, last name, age, email address and proof of ownership of winning Platform Account in order to redeem the Competition prize.

9. Prize: There are ten (10) prizes; five (5) prizes per Competition Platform.

Ten (10) winners will each receive a prize of one (1) $250 wotif.com.au coupon (prize) for use on a select hotel stay only. Approximate retail value of each prize: $250 AUD; total Competition prize value is $2,500 AUD. Any difference between the stated value and actual value will not be awarded.

Winners are responsible for paying all applicable federal, provincial, state, local, income and withholding taxes, if any. In the event that any tax withholding is required by law for the prize, a winner authorises Sponsor to make the corresponding deduction. Any prize details not specified above will be determined by Sponsor, in its sole discretion. Winners may not transfer, assign or substitute the prize, or redeem prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize must be accepted as awarded. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by Sponsor.
The prize will be provided by the Promoter. Specific Prize details are at the discretion of the Promoter.

10. Unclaimed Prizes: In the event a prize winner fails to claim his or her prize by 4:00 pm AEDT, Tuesday 16 August 2022, the prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit. There will be no rejudging and in the event that the prize is unclaimed, no replacement winner will be chosen. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.

11. General Conditions: In the event that the operation, security, or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) award the prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsor by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsor (as applicable). The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited.

12. Collection and Use of Your Personal Information: Expedia may collect and process your personal information directly or through our agents or contractors. We will use your personal information as necessary in order to conduct and manage the Competition, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this competition, communicating with you, or storing data. This may include disclosures to organizations outside Australia in places such as the United States.

13. Release and Limitations of Liability: By entering, you agree to release and hold harmless the Promoter and Expedia, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact may entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

14. Disputes: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of NSW or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia.

15. Results: The winner will be announced within 2 business days of the prize draw on the following wotif.com subdomain: https://www.wotif.com/g/rf/competition-winners and displayed for a period of 28 days.
