Pool:
By booking, you accept responsibility for the safe use of the pool. The pool depth reaches 5 feet at its deepest point—supervise children and non-swimmers closely. No lifeguard on duty, no diving, and no jumping from balcony.
Dust storms may introduce debris, so please keep the pool vacuum connected. Pool brush and skimmer are located in the garage, if needed. No glassware allowed near the pool. Avoid using tanning oil before swimming, as it affects pool chemicals.
Pool heating is available at $50/night + $75 preheating fee (minimum of 3 consecutive days, starting on arrival). For 2 night stays, a flat fee of $225 to have the pool heated for your stay. Payment and notice are required at least 5 days in advance. Pool to be heated to 85°F.
Note - The expected uncontrolled temperature range for the pool is between 65°F to 85°. Please be aware that variations in outdoor temperatures, seasonal changes, and unexpected weather events may impact the pool water temperature.
Home Service:
Home is professionally cleaned before each check-in. Pool and yard services are scheduled weekly; We will let you know if this coincides with your stay.
Other things to note
- Children must be supervised at all times when outside in the backyard
- Please be mindful of noise levels, especially during quiet hours (nominally 10 PM to 8 AM). Violations may result in fines, neighbor complaints, or eviction at the owner’s discretion.
Additional Rules of property:
1. Use and Smoking/Vaping: Renter shall use and occupy the Property only for private residential purposes for the number of occupants and for Renter’s temporary hosting and entertainment of Renter’s guests. Renter shall not use the Property and shall not permit to it be used in any other manner. Renter shall not and shall not permit others to smoke/vape anywhere substance on the Property, nor are smokers smelling of their respective smokeable substance allowed in the home. Renter agrees that a breach of this smoking/vaping prohibition will cause damage that is difficult to quantify, and Renter therefore agrees to pay Landlord the sum equal to the rental rate as defined in this Agreement as liquidated damages for such breach.
2. Negligent Use of Property: Renter shall not use the Property or permit it to be used for any disorderly or unlawful purpose or in any manner so as to interfere with other persons’ quiet enjoyment of their property. Renter will comply and to cause other occupants, guests, and invitees to comply with all laws of the country, state, and locality in which the Property is located and with all homeowner's association rules, covenants, conditions, and restrictions applying to the Property, a copy of which Landlord agrees to provide at the Property on the rental start date. For the purposes of this Agreement, unlawful purpose includes the storage, use, or location on the Property of any drug or substance the storage, use, or possession of which is prohibited by any law or regulation of a government having jurisdiction of the area in which the Property is located. Renter shall not permit any portion of the Property to be used in any manner, and Renter and all occupants shall not engage in any activity in connection with the Property and whether at or away from the Property, that may endanger the person or property of the Landlord or of any third-party. Renter shall keep all parts of the Property in clean, sanitary, safe, and habitable condition and shall not make any alterations, modifications, repairs, or additions to the Property without first obtaining the Landlord’s written consent.
3. Pets: pets allowed upon request. Please inquire about bringing your pet before upon booking.
4. Fire, Casualties, and Condemnation: If a residential dwelling on the Property becomes uninhabitable because of fire, explosion, or other casualty of if taken in condemnation, this Agreement will terminate by its own terms as of the date Landlord receives notice of such uninhabitability or taking from the governmental agency or official having authority to make such declaration with respect to the Property.
5. Right of Access: Landlord shall have the right of access to the Property for inspection and repair or maintenance during reasonable hours upon Renter's request or Landlord’s twenty-four (24) hour prior notice. In case of emergency, Landlord may enter at any time to protect life and prevent damage to the Property. Case of emergency also includes any environmental factors that may cause damage or loss of any external property including but not limited to: excessive winds exceeding 30mph, Monsoons, 'Haboobs', etc.
6. Hold Harmless, Waiver of Claims, and Indemnification: Renter agrees that Landlord shall not be liable, responsible, or in anywise accountable for any loss, injury, death, or damage to person or property that may be suffered or sustained by Renter or by any person who may at any time be using, occupying, or visiting the Property, whether such loss, injury, death, or damage is directly caused by or in any way a result of any act, omission, or negligence of Renter; of any occupant, visitor, or user of any portion of the Property; of Landlord; or of any agent, employee, or invitee of Landlord or third-party except where such loss, injury, death, or damage is due to Landlord's gross negligence or willful act; provided, however, that Landlord shall not be liable for any loss, injury, death, or damage not caused by its own gross negligence or willful act or that of its employees or agents. Renter agrees to indemnify, defend, and hold and save harmless Landlord of, from, and against all claims, liability, loss, or damage whatsoever, including attorney’s fees and costs of suit, on account of any loss, injury, death, or damage occurring on the Property or arising from the use of the Property. Renter agrees that if Renter or any person deriving use of or access to the Property by or through Renter shall have any claim against Landlord under or arising out of this Agreement, Renter’s and all persons deriving use of or access to the Property by or through Renter’s sole recourse shall be against Landlord’s interest in the Property and not any other property or assets of Landlord.
5.a. Balcony: No more than 3 individuals on balcony at any one time and must be used for sightseeing only. Jumping off balcony into the pool will be immediate grounds for being removed from the property.
6. Sublease and Assignment: Renter may not sublease any part of the Property. Renter may not assign this Agreement without first obtaining Landlord’s written consent. Landlord may, without notice, assign this Agreement in whole or in part, and any such assignment shall operate to release Landlord from liability for all of the covenants, terms, and conditions of this Agreement, express or implied, from and after the effective date of such assignment and Renter shall thereafter look solely to Landlord’s successor in interest to this Agreement.
7. Additional Occupants: Any additional occupants above the max number allowed per this Agreement and/or any individuals in addition to the occupant names listed herein shall result in an additional rental fee of $150 per new occupant relative to this Agreement.
8. Landlord’s Failure to Act: Landlord’s failure to insist upon full compliance with any term or condition of this Agreement shall not constitute a waiver of any breach, a continuing waiver, or a waiver of any subsequent breach.
9. Decorative Wine on Property: There are bottles of wine in the kitchen and foyer that are used for decorative purposes only. Renter agrees that Landlord shall not be liable, responsible, or in anywise accountable for any drinking, loss, injury, death, or damage to person or property that may be suffered or sustained by Renter or by any person who may at any time be using, occupying, or visiting the Property, whether such loss, injury, death, or damage is directly caused by or in any way a result of any act, omission, or negligence of Renter in accessing/opening said decorative wine.
